Privacy policy.

How Every-Bodies Dietetics Pty Ltd collects, uses, stores and gives you access to your personal information under the Privacy Act 1988.

Every-Bodies Dietetics Pty Ltd (ABN 46 662 766 305) ("we", "us") respects your privacy. This policy explains what personal and health information we collect, why we collect it, who we share it with, how we keep it safe, and how you can get access to it or have it corrected.

We handle your information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Health service providers are covered by that Act no matter how small they are, so it applies to us in full. Some states and territories have their own health records laws as well, and where one of those applies to a clinic you attend, we follow it too.

The information we collect

Most of what we hold is health information. The law treats that as sensitive information and protects it more strictly than ordinary personal details. It includes:

  • Your name, date of birth, address, phone number and email address.
  • Your Medicare number, DVA number, NDIS participant number, private health fund details and any concession card, where these apply to your care or your claim.
  • Your medical and dietary history, your goals, measurements taken during your appointments, nutrition assessments and care plans, test and pathology results, and correspondence with other practitioners involved in your care.
  • Your emergency contact, and for a client under 18, their parent or guardian’s details.
  • For NDIS clients, the parts of your plan and your plan manager’s details that we need in order to deliver and invoice for your supports.
  • Payment and billing records.

How we collect it

Usually straight from you: when you book, when you fill in our new client paperwork, during your appointment, or when you contact us by phone, email or through the form on this website.

Sometimes we receive it from someone else, such as a referring GP or specialist, a hospital, a support coordinator or plan manager, an insurer, or a parent or carer acting for you. Where we collect information about you from someone else, we take reasonable steps to make sure you know we have it.

Why we collect it and how we use it

  • To assess your nutrition needs, to treat you, and to plan and review your care over time.
  • To contact you about your appointments, including reminders and follow-ups.
  • To bill you, and to process Medicare, DVA, NDIS, private health and insurance claims.
  • To answer your enquiries and to respond to feedback or a complaint.
  • To meet our legal, professional, insurance and accreditation obligations, including those that come with being Accredited Practising Dietitians credentialled through Dietitians Australia.
  • To improve our service, using information that does not identify you wherever we can.

We only send you marketing if you have asked for it or would reasonably expect it, and every message includes a way to opt out. We never use your health information to target advertising at you, and we never upload client lists to an advertising platform.

Who we share it with

We do not sell your information. We do not share it with anyone unless you have agreed, or the law requires or allows it. In practice that means we may share it with:

  • Other dietitians on our team who are involved in your care, or covering for your usual dietitian.
  • Your GP, specialist or another treating practitioner, where you have consented or where it is directly related to your care.
  • Medicare, the Department of Veterans’ Affairs, the NDIA, your plan manager or support coordinator, your private health fund, or an insurer or third-party payer, where a claim or a funded program applies.
  • The clinic, medical centre or gym that hosts the room we see you in, but only the minimum they need to run the appointment, such as your name and appointment time.
  • Our practice management and booking system, Halaxy, and our telehealth, accounting and payment providers, who store and process information securely on our behalf under contract.
  • Our professional indemnity insurer or legal advisers, if a claim or complaint is made.
  • Anyone we are required to disclose to by law, including under a court order or subpoena, or where disclosure is needed to lessen a serious threat to someone’s life, health or safety.

Some of the providers we use store information on servers outside Australia. Where that happens we take reasonable steps to make sure they protect your information to the standard the Australian Privacy Principles require.

This website, cookies and advertising

This website uses cookies and similar technologies. Some are ours and some belong to third parties we have engaged. We use them for analytics and for advertising, and we would rather say so plainly than bury it.

  • Analytics, currently Google Analytics and Google Tag Manager, which tell us things like which pages people read, how they found us, and whether a page led to an enquiry.
  • Advertising and conversion tracking from Google and Meta (Facebook and Instagram), which tell us whether an ad led to a booking so we know what is worth running.
  • Remarketing, also called retargeting. If you visit this site you may later be shown our ads on Google, YouTube, Facebook or Instagram. That is based on your having visited the site, not on anything you have told us about your health.

No health information is ever passed to an advertising platform, and we do not build or upload audiences out of anything you tell us as a client. The tracking on this website only ever sees website activity.

You can block or delete cookies in your browser settings, and you can turn off ad personalisation in your Google and Meta account settings. Parts of the site may not work as well if you block cookies.

If you send us a message through the form on this website it reaches us by email. Email is not a secure channel, so please do not use it to send detailed health information. Call us on 1300 859 771 instead, or raise it at your appointment.

Telehealth appointments

Telehealth appointments run over a secure video platform. We do not record your appointment unless you have asked us to and agreed to it in writing. Your dietitian will be somewhere private, and we ask that you are too, because we cannot control who is in the room at your end.

How we store and protect it

Your records are held electronically in our practice management system, Halaxy, and access is restricted to the people who need it to do their job. Systems are password protected, any paper records are kept in a secure area, and our team is trained on their privacy obligations.

No system can be guaranteed completely secure, but we take reasonable steps to protect your information from loss, misuse and unauthorised access, and we destroy or de-identify it securely once we no longer need to keep it. If a data breach happens that is likely to cause you serious harm, we will tell you and the Office of the Australian Information Commissioner, as the Notifiable Data Breaches scheme requires.

How long we keep it

For an adult, we keep health records for at least seven years from the date of your last appointment. For a client who was under 18 at the time, we keep the record until they turn 25. Some funding programs require us to keep billing records for longer, and where they do, we do.

Getting access to your information, and correcting it

You can ask to see the information we hold about you, and to have it corrected if it is wrong, out of date or incomplete. Contact us using the details below. We may ask you to put the request in writing and to confirm who you are, and there may be a fee covering the cost of producing copies.

We will respond within a reasonable time. There are limited situations where we may not be able to give you access, for example where doing so would pose a serious threat to someone’s life or health, or would affect another person’s privacy. If that happens we will explain why, in writing.

Making a complaint

If you think we have mishandled your information, please tell us first, using the details below. We take complaints seriously, and we will investigate and come back to you.

If you are not happy with our response, you can take it to the Office of the Australian Information Commissioner at oaic.gov.au. If your complaint is about your care rather than your privacy, the health complaints body in your state or territory can also help, and in Queensland that is the Office of the Health Ombudsman.

Changes to this policy

We may update this policy from time to time. The version on this page is always the current one, and the date at the top tells you when it last changed.
